Consulting on Local/Regional Ordinances

Many municipalities and other local/regional governmental bodies are either looking to develop new, or to update older, ordinances or regulations relative to the antenna structures and other facilities that wireless communications systems almost invariably employ.

Some well-intentioned but misguided local government entities may be seeking, to develop and enact forms of regulation designed to "prevent interference" or to "protect citizens from the 'harmful effects of radio frequency emissions'."

Many, if not most, such governmental bodies fail to understand that the Federal Communications Commission has pre-empted local regulation of many matters relating to radio communications services and facilities.

While not attorneys, WK3C Wireless LLC can never the less help such governmental bodies to avoid the problems and potential legal exposure associated with the inadvertent enactment of regulations that overstep their authority under the aforementioned federal preemptions of local regulation.

If you serve on a local or regional government body and would like to have an independent evaluation of your existing regulations relating to antenna structures and other matters relating to radio communications services and facilities, or would like assistance in developing or updating such regulations, please contact us for further information.
